These Terms and Conditions ("Terms") govern your access to and use of Sharecocktail and related services (the "Service"), operated by Iurii Zaitsev, sole proprietor, Serbia, Tosin Bunar 270, 11070 ("we", "us", "our").

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this requirement.

2. Service Description

Sharecocktail provides digital premium features, including but not limited to background replacement, cocktail recipe generation, and other premium functionality made available from time to time.

Features may be changed, improved, or discontinued at any time.

3. Account

You are responsible for providing accurate account information, maintaining account security, and all activity under your account. We may suspend or terminate accounts that violate these Terms.

4. Subscription, Billing, and Auto-Renewal

Your subscription renews automatically each billing cycle unless canceled. You authorize recurring charges for the subscription until cancellation.

5. Payment Processing (Paddle)

Payments are processed by Paddle, our authorized Merchant of Record/payment provider. By purchasing, you may also be subject to Paddle's buyer terms and privacy policies.

6. Cancellation

You may cancel anytime from your account settings or by contacting us at admin@sharecocktail.com. After cancellation, access to premium features continues until the end of the current paid billing period. No further renewals will be charged after cancellation.

7. Refunds

Refunds are allowed and reviewed case-by-case. To request a refund, contact admin@sharecocktail.com and include your purchase email and transaction details. We may deny refund requests in cases of abuse, fraud, or repeated refund misuse.

8. Acceptable Use

You agree not to use the Service for unlawful activity, attempt unauthorized access to systems or accounts, interfere with or disrupt the Service, or misuse generated content in ways that violate law or third-party rights. Because the Service concerns alcoholic cocktails, you must use it responsibly and lawfully.

9. Intellectual Property

The Service, including software, branding, design, and related content (excluding user-generated content), is owned by us or our licensors and protected by applicable intellectual property laws. You receive a limited, non-exclusive, non-transferable right to use the Service during an active subscription.

10. User Content and License

If you upload or submit content, you retain ownership of your content. You grant us a non-exclusive, worldwide, royalty-free license to host, process, and display that content only as needed to operate and improve the Service. You are responsible for ensuring you have rights to content you upload.

11. No Professional Advice

Content generated by the Service is for informational and entertainment purposes only. We do not provide medical, health, nutritional, or legal advice. Always act responsibly with alcohol consumption.

12. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted, error-free, or completely secure operation.

13. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability arising from or related to the Service will not exceed the total amount you paid for the Service in the 12 months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

14. Indemnification

You agree to indemnify and hold us harmless from claims, liabilities, damages, losses, and expenses arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or third-party rights.

15. Suspension and Termination

We may suspend or terminate access immediately if you materially breach these Terms, if required by law, or if necessary to prevent fraud, abuse, or security risk.

16. Changes to the Service or Terms

We may update the Service and these Terms from time to time. If we make material changes, we will post the updated Terms with a new "Last updated" date. Continued use after changes means acceptance of the updated Terms.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of Serbia. Any dispute arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the competent courts in Belgrade, Serbia, unless mandatory law requires otherwise.
